The Massachusetts legislature has recently passed a bill signed by the Governor, which will become effective next year, making it illegal to ask a prospective candidate how much money they were earning in their prior job.  Combined with the New York State rule prohibiting requests about a candidate’s past criminal record during the initial job application process, these laws will tighten up the questions that can be asked during the hiring process.  This alert, although currently narrow in scope, is expected to set the pattern for other states to follow.
